Research On The Change Of Ownership Of Special Movables

According to current Property Law in China,the article that directly regulates the changes of the ownership of special movables is Article 24 of the law.However,the effective form of changing the ownership of special movables,what “registration confrontation” means need to be clarified.And what “third parties in good faith” means,along with how to deal with conflicts of delivery and registration,still remain unclear.This thesis will focus on Article 24 and then clarify the above issues.Chapter ? in this thesis mainly discusses the particularity of special movables and clarifies the concept of special movables.Chapter ? demonstrates the legitimacy of the “Delivery Theory” by combing through some pre-existing doctrines and combining the legal interpretation.Chapter ? focuses on the explanation of the sentence of “without registration,one can not challenge”.Chapter ? then explores the scope of the “third party in good faith”and clarifies the relationship between Article 24 and Article 106.
