A Study On The Examination And Judgment Of Appraisal Opinions Outside The "Four Categories"

With the development of social economy,the number of litigation cases with various technical problems increases greatly.Scientific evidence plays a more and more important role in modern litigation system.In recent years,there has been a sharp contrast between the system of judicial expertise in the "four categories" and those outside the "four categories".Based on the existing research results of the rules of appraisal opinion review and judgment,this paper discusses the appraisal opinion review and judgment of judicial appraisal outside the "four categories".This paper is divided into three chapters.The first chapter expounds the basic concept and system of judicial appraisal and appraisal opinion,which paves the way for the full text.In chapter two,the author expounds that there exist some problems of neglect in the rules of the examination and judgment of expert opinions outside the "four categories",and some errors in the position of the evidence of expert opinions outside the "four categories".On the basis of the comparison of the expert opinions outside "four categories" and "four categories",four perplexities in the examination and judgment of expert opinions outside "four categories" are sorted out.In chapter three,on the basis of clarifying the concepts of inspection and identification,it is concluded that the identification opinions outside the "four categories" and the "four categories" belong to the same identification opinions and are one of the types of legal evidence.Due to the differences in the appraisal system,the appraisal opinion review and judgment rules other than the "four categories" can be transformed and applied from the comparison of appraisal system.On the basis of the comparison of appraisal systems,this paper analyzes and sorts out several main problems in the appraisal opinions examination and judgment outside the "four categories",and puts forward corresponding solutions.This paper is intended to draw attention to the examination and judgment of appraisal opinions outside the "four categories",so as to construct a complete appraisal opinion examination and judgment rule suitable for China's unique appraisal system.
