Research On The Application Of Occupation Prohibition

In November 2015,The "Amendment IX to the Criminal Law " added an occupation prohibition.In recent years,there have been an increasing number of cases applied occupation prohibition in judicial practice,and the problems that have emerged during this period have also attracted the attention and research of the academic community.This paper will organize the cases of applying occupation prohibition in judicial practice to discover the problems and analyze the problems with theoretical perspective to find solutions.This paper mainly focuses on the four aspects of the prohibition period,the scope of application of the occupation prohibition when the suspension of sentence is announced,the relationship between the occupation prohibition and the criminal prohibition order,the connection between the occupation prohibition and the administrative prohibition of occupation,the definition of occupation and the scope of occupation.At the same time,for the solution of the judicial application of the occupational prohibition,this paper discusses the penalty concept of the security measures.on this basis,then through the legislative and judicial aspects to solve the above-mentioned specific problems,so as to achieve the purpose of further improving the judicial application of the occupation prohibition.
