| The implementation of the national guardianship system is not only important to the personal interests of the ward,but also to family happiness,social stability,and social interests.It is an important responsibility that the state should assume.The guardianship system is a unique system in the traditional field of civil law.Because of its importance,it has increased the involvement of public power in the state.Moreover,the role of public power in the state has become stronger and stronger,thus making the guardianship system with both public and private law characteristics.However,the current national guardianship system in China has certain shortcomings.The "General Principles of Civil Law" of 2017 has systematically designed the guardianship system,reflecting the latest development trend of the modern guardianship system.However,due to its principles,the characteristics of national guardianship have not can be fully demonstrated.Based on this,this thesis focuses on the basic legal issues of China's national guardianship system.It starts with a new type of system of state guardianship,explaining what is state guardianship,what theoretical basisdoes it have,and whether it can be supported by legal principles,and clarifies the necessity of the state guardianship system in China's real life.Then,it analyzes the specific provisions of the current system of our country on the specific provisions of the state system,and what are the shortcomings of such provisions,so as to make relevant suggestions and countermeasures.Finally,as to how to improve China's national guardianship system,we mainly cut into and proceeded from specific legal issues such as responsible subjects,nature,specific content,exercise methods,liability analysis,and guardianship supervision,and proposed relatively comprehensive and targeted Sexual countermeasures,with the hope to enrich and supplement the gaps in the legal field of this part of the country,and improve our national guardianship system. |
