| On March 20,2018,China's supervision law was promulgated.Three days later,the China's supervisory commissions was established.It means a centralized,unified,authoritative and efficient supervisory regulation of the China Party was generaed.The new law,an essential part of China's reform of supervisory institutions,is the basis serve as a fundamental and guiding law against corruption and for state supervision.This is a major political system reform carried out by the Communist Party of China(CPC)Xi Jinping as the core,in order to strengthen the party leadership and the anti-corruption struggle under the new situation.concluded the anti-corruption,anti-crime and comprehensive prevention departments in the procuratorate.Come out and work together with the Commission for Discipline Inspection to form a new anti-corruption struggle force,supervise all public officials who use public power,and achieve comprehensive coverage of supervision.The supervisory commissions perform its duties of supervision,investigation and disposal.The lien measures in the investigation are clearly defined as a measure to replace the "liang gui" in the report of the 19 th National Congress,and they are related and different from the "two regulations".There are differences in other coercive measures,too.So far,there is no unified understanding of the retention measures.The existing laws on the connotation of the retention measures,the procedures for exercising the procedures,and the judicial connection mechanism are not yet clear,and the compensation,relief mechanism and human rights of the invaders.The guarantee is not fully regulated.This reaserch,trying to find out the lien measure in the fact,the various problems in the actual application process,such as retention time,lien procedures,places of detention,non-specific means of relief,rights protection,supervision mechanism And other issues,and then put forward specific procedures to improve the lien measures. |
