Research On Judicial Identification Of Terrorist Personnel

The "Anti-Terrorism Law of the People's Republic of China",which came into effect in 2016,officially stipulates the subject of our terror determination,and determines the system for the identification of the organization of terrorist activities and the identification of terrorist activities and the judicial recognition system.However,judicial recognition has not received much attention.Moreover,the defects in the judicial identification system of terrorist activities in China have not been perfected.This paper studies the issue of improving the judicial identification system of terrorists in China.The research idea of this paper is to define the legal meaning of the judicial identification of terrorist personnel,to sort out the legal provisions of judicial identification of terrorist activities,analyze its practical application,summarize the shortcomings of the judicial identification of terrorists,and the judicial identification of terrorist personnel.The problem is raised and the recommendations are perfect.The first part of this paper discusses the basic theories of terrorist personnel identification,expounds the connotation of terrorist activities and their identification,summarizes several identification models of terrorist activities in various countries,summarizes the characteristics of judicial identification system,and what principles should be followed in the judicial identification process..On this basis,the second part analyzes the legal provisions and judicial practice of the judicial identification of terrorists in China,and summarizes the inadequacies of the judicial identification of terrorists in China.For example,the lack of judicial identification standards,the identification procedure is not clear,administrative identification and justice It is found that the connection is vague and the judicial confirmation mechanism is not clear.The third part puts forward some suggestions for improving the judicial identification of terrorists in China.It is to improve the standards and procedures for judicial recognition,to clarify how to link between administrative and judicial determinations,and to revoke and other remedies after judicial errors.Only with strong and perfect institutional support,the practice of terrorist activities can achieve the efficiency and justice of the maximum procedure,and improving the judicial identification system for terrorist personnel is an inevitable requirement for building a country ruled by law.Improving the judicial recognition system for terrorist activities is an inevitable requirement for implementing the rule of law,preventing and combating terrorist activities,and safeguarding human rights.
