Study On The Legal Regulation Of People's Police's Use Of Stun Guns

At present,China's social economy is in the developing transformation period of socialism after rapid development.The imbalance of social and economic development has led to the concentrated outbreak of various social contradictions and conflicts.Violent crimes have occurred frequently.The batons,handcuffs,pepper sprays and other weapons equipped by the grassroots police are no longer enough to deal with the complicated police situation.They have even seriously influenced and restricted the law enforcement activities of the grassroots police.As a result,many unnecessary bloodshed sacrifices have been made and people have been wounded by misusing police weapons accidentally.In the complex and changeable law enforcement environment of the new era,the stun guns have the characteristics of low killing and strong control.The use of them by the police is conducive to enhancing the enforcement and fully protecting the legitimate rights and interests of citizens.The main content of this paper consists of three parts.The first part mainly introduces the current situation of police using stun guns;the second part points out the shortcomings of police using stun guns in our country by sorting out the relevant laws and regulations of stun guns and combining with the practical experience of other countries on stun guns.The third part puts forward some innovative suggestions on how to distinguish ordinary police weapons and use stun guns,which aims at the problems between the use of ordinary police equipment and the upgrading to the use of guns and weapons,and suggestions on improving the relevant supporting mechanisms,which aims at the possible judicial risks of using the stun guns.
