To Improve The Legal System Of China's Personal Date Authorization

Data in the information age is as important as oil in the industrial age.Big data has penetrated into every aspect of people's lives,and it also provides great convenience.However,people often neglect the protection of personal data authorization in order to enjoy convenience and preferential services.When the Internet giant pursues interests,it often takes the rights of data subjects left behind.Effective on May 25,2018,the promulgation of the EU General Data Protection Regulations has produced a wide and profound impact on a global scale,setting a new benchmark.The regulations on the authorization of personal data are of great significance to the construction of China's personal data legal system.The meaning of reference unlike the special personal data protection law issued by the European Union,there is no specific personal data protection legislation in China.The rules for personal data protection are scattered among various laws and regulations.In the era of big data,personal data is the focus of legal norms,and personal data is authorized as the first pass in personal data protection,its effective specification is critical to personal data protection.This paper is divided into three parts:The first part is an overview of the authorization of personal data in China.This part mainly starts from the basic elements of personal data,analyzes the definition,meaning and attribute of personal data,then discusses the basic theory of personal data authorization,analyzes the definition of personal data authorization,related subjects and contents,and finally studies the authorization of personal data in China.The status quo,expounding the relevant legislative provisions on the authorization of personal data in China,the main manifestations and methods of responsibility for infringement of personal data authorization.The second part is the authorization of personal data in the EU General Data Protection Regulations.The contents of the Regulations related to the authorization of personal data are analyzed chapter by chapter,and the general principles,data subject rights,data controllers,processor obligations,remedies,responsibilities and penalties related to personal data authorization are discussed.experiences that can be used in the authorization of personal data,including the advantages of reference and the avoidance of shortcomings.The third part is to construct the legal system of personal data authorization in China.Combined with the basic theory of personal data authorization,this paper analyzes and studies the personal data regulations of the EU General Data Protection Regulations and the status quo of China's personal data authorization,and proposes three aspects to construct the legal system of personal data authorization in China.
