A Research On Legal System Construction Of Military-civilian Integration Development In The New Period

In today's world,technological,economic,military and other fields are undergoing unprecedented changes.In order to achieve the coordinated development of economy and military,major countries have vigorously promoted the development of military-civilian integration.Since the eighteen years of the Communist Party of China,the development of military-civilian integration has made new achievements,and has risen to the national strategy.However,due to China's military-civilian integration has just entered the transition stage from initial integration to the depth of integration,there are still various levels of management system is not smooth,high threshold,private army military and civilian standards are not uniform and other issues,these problems are hard to apply the rule of law thinking,perfecting the legal system can really solve.In view of this,this paper focuses on the construction of military-civilian integration legal system,and makes a more systematic research and analysis.The vertical dimension,summarizes the basic situation of our country in different historical stages of development of military-civilian integration and the construction of legal system,and analyzed the existing overall current situation,the construction of legal system of military-civilian integration problems and reasons;the horizontal dimension,including the United States,Russia,Japan,Israel,the EU and its member states and other representative countries and in summary,the main approach of military-civilian integration experience and enlightenment.On this basis,put forward to strengthen our general idea of integration of military and civilian legal system construction: to promote the depth of integration and development as the goal,the use of legal thinking and legal means,optimize the top-level design,straighten out the mechanism,adhere to the general and special legislation principle,to speed up the policy and the law to waste release etc.accelerate the establishment of military-civilian integration,improve the legal system.Specific measures of legislation is the " one to many " : the introduction of a comprehensive guide and the basic law of fusion development;establish and improve the private army,military standard,intellectual property rights,taxation policy and security and other areas and levels of special legislation.Finally,through the improvement of legal construction to solve the problem,to provide a strong guarantee for the development of military-civilian integration.
