On The Perfection Of The Legislation Of Juvenile Criminal Responsibility In China

Domestic research in the field of juvenile criminal responsibility has not developed for a long time,and the relevant legal system needs to be improved or the relevant legal content is distributed in other laws and regulations,which makes judicial enforcement and academic research face many difficulties.This paper consists of introduction,body and conclusion.Through describing the importance of minors and the current situation of crime,this paper clarifies the main problems faced by minors' criminal responsibility,and further studies the legislative situation of minors' criminal responsibility in China;the imperfect legislative system,imperfect legislative content,defective penalty,few non-penalty penalty methods,single form and other issues,and proposes to promote integration.To optimize the legal content of juvenile delinquency,we should optimize the principal punishment of juvenile delinquency,exempt from property-based punishment and deprive of political rights by improving the system of criminal responsibility for juvenile delinquency,so as to build the corresponding legislative system;to use the system of eliminating criminal record of juvenile delinquency and reducing conflicts between laws;Improve the relevant provisions of the penalty legislation;improve the non-penalty measures for juvenile delinquency by increasing the types of Non-penalty penalty measures and standardizing the provisions of Non-penalty penalty measures.
