To Build A Subsidy System For Agricultural Land Due To Land Use Restriction In Theory

Article 4 of the Land Management Law of the People's Republic of China stipulates that "the State shall implement the land use control system." Land use control refers to the restriction of land use by the state in a planned way.Agricultural land is the land restricted for agricultural use by the government according to the land use control system.Agricultural land subsidy based on land use control refers to the administrative subsidy given to the owner of agricultural land property because of the land use control system and its influence on the owner of agricultural land property.Land use control is indispensable to the stability and development of national economy in macro sense,and is of great significance to the protection and development of agriculture.However,for farmland,land use control restricts that farmland can only develop agriculture,and deprives farmland of the possibility of developing other industries.According to China's national conditions,there is a big gap between the level of agricultural development and the secondary and tertiary industries in China.Therefore,land use control has created obstacles for the owners of agricultural land property to obtain greater economic benefits.However,the owner of agricultural land property has contributed to the social and public interests pursued by land use control.Therefore,this paper proposes to build a subsidy system for agricultural land based on land use control.This paper analyses the legal basis of constructing the farmland subsidy system based on land use control from two aspects of right standard and obligation standard,and analyses that the essential attribute of the farmland subsidy system based on land use control is not the compensation of real estate levy,but the administrative subsidy.The necessity of agricultural land subsidy system based on land use control lies in restraining the illegal use of agricultural land by the owner of agricultural land property.The rationality lies in restraining the government's prudent planning and paying attention to the location price difference of land in the process of land use planning.The feasibility of farmland subsidy system based on land use control lies in that the subsidy funds have specific sources of funds for protecting farmland,and the study of land resource management has made a breakthrough in the calculation method of subsidy amount.Therefore,this paper suggests that the subsidy system of farmland based on land use control can be constructed in China.
