Research On Personal Information Network Infringement

With the advent of the information era,various information of mankind through the network for communication and dissemination,personal information has gradually become valuable.As a result,the phenomenon of network infringement of personal information is getting worse.How to protect the personal information online has drawn a great attention of all social circles.In real life,personal information is infringed by intermediary services,online shopping,financial lending,learning and education and other online behavior,so it is urgent to carry out personal cyber information protection.So far,China has not promulgated any specific law to protect personal information.Although general provisions of civil law and other laws have made some regulation on the protection of personal information,but in reality,the existing laws in China are still unable to fully protect personal network information.This paper will use the methods of documents analysis,investigation and research,contrast research and case analysis to study the current situation of infringement of the network personal information in China,learn from the experience of protecting personal information security in foreign countries,and provide theoretical basis for solving the problem of infringement of the network personal information in China.The right of personal information is an important part of the right of personality in the coming civil code.In this paper,the right of personal information is systematically analyzed,which provides theoretical support for the prevention of personal information network infringement.On the foundation of combing the basic theories of infringement of the network personal information,including the definition of personal information right,the identification of infringement of the network personal information,the relief methods of personal information network infringement,etc.,combined with the current scattered legislation of infringement of the network personal information in China,the lack of self-discipline in the internet industry,the difficulty in determining spiritual damage compensation,and the vacancy of punitive compensation,etc.,the paper draws lessons from the United States in order to improve the protection of the infringement of personal information network in China,some legislativesuggestions are put forward.
