Research On Civil Liabiality Of Reward-based Crowdfunding

As one of the modes of Internet finance,reward-based crowdfunding has developed rapidly in China in recent years,playing a very important role in promoting innovation and entrepreneurship in China and solving the financing difficulties of newly-established small and micro enterprises.However,due to the lag and shortage of relevant legislation in China,the reward-based crowdfunding in the current laws and systems,while playing a role,there are also a lot of legal risks,breeding many legal problems,supporters of legitimate rights and interests are repeatedly hurt,but their interests are often not effectively protected.In this paper,I hope to put forward the assumption of the responsibility of the crowdfunding platform and the sponsor through the analysis and discussion of the legal relationship between the reward-based crowdfunding and the loss of the supporter's interests,so as to better protect the legal interests of the supporter.From the perspective of the protection of supporters' interests,this paper starts with the determination of the legal relationship of reward-based crowdfunding,and clearly defines the nature of the legalrelationship between the subjects of reward-based crowdfunding by analyzing and discussing the viewpoints of different theories.Secondly,this paper conducts a typified analysis on the damage of supporters' interests in reward-based crowdfunding,and explores the causes.Finally,it is relate to all the supporters in the interests of the two big main body which is civil liability of crowdfunding platform and sponsor of the relevant legal issues,including specific problems such as basis of liability,type of responsibility,methods of responsibility.This article have conducted a detailed analysis and discussion,thus put forward respectively in the framework of liability for breach of contract and tort liability,how to carry on the responsibility of the raised platform and project sponsors,supporters in order to benefit fully effective protection.
