Study Of Further Improvement Of The System Of People’s Assessors

The system of people’s assessors is an important means for ensuring the citizen’s right to serve as an assessor in a court trial and making the masses feel equality and justice.The system of people’s assessors with Chinese characteristics has gone through twists and turns of development.The Fourth Plenary Session of the 18 th Central Committee of the Chinese Communist Party has clearly put forward to improve the system of people’s assessors,to guarantee the citizen’s right to serve as an assessor in a court trial,and to improve the credibility of the system.With the judicial reform,the system of people’s assessors has made great achievements in legislation and has made general stipulations on the terms of selection and appointment,the scope of participation in a trial,and measures of management,etc.However,there are many problems existing in the implementation of the system.For example,the mechanism of selection and appointment is not improved;the mechanism of participation in a trial is unsound;the mechanism of management is not scientific;and social awareness of the system is deficient.Therefore,the mechanism ofselection and appointment should be improved by reasonably adjusting the terms for selection and appointment,by implementing the mode for selection and appointment at random,by preventing the homogenized selection of the assessors,and by appointing professional assessors,etc.In addition,the mechanism of participating in a trial should be perfected by guaranteeing the assessors’ right to review files prior to the trial and the right to speak during the trial,and by specifying the scope of participation in a trial.Then the scientific mechanism of management should be established by strengthening training,raising economic guarantee,and perfecting the system of accountability.Finally,social awareness of the system of people’s assessors should be enhanced with all-round means and multiple channels to provide an excellent atmosphere of the operation of the system.The study of the system of people’s assessors is very helpful to realize its important value of promoting judicial democracy and ensuring judicial justice when the system is normally and effectively implemented.
