The Research On The Protection For Artificial Intelligence Generated Materials

With the development of artificial intelligence technology,“works” of literature,art and music are increasingly being generated by the execution of artificial intelligence programs.Are these materials copyrightable? Who should be the author of them? This thesis analyses the issues concerning the copyrightability and ownership of artificial intelligence generated materials.First,it introduces the concepts about artificial intelligence and the process of generation.Compared with computer generated materials in 1990 s,artificial intelligence generated materials are different,which are based on neural networks attempting to imitate the human brain.Secondly,the thesis analyses the copyrightability of artificial intelligence materials based on the balance of interests theory and concludes that in order to promote artificial intelligence industry,artificial intelligence generated materials should be copyrightable.Thirdly,the thesis evaluates who should be allocated copyrights based on the economic incentive theory and suggests the users of artificial intelligence programs should be entitled to the copyrights.
