A Study On The Benefit Sharing Mechanism Of International Seabed Resources Development

The international seabed Area is composed of the legal system of the United Nations Convention on the Law of the Sea(UNCLOS)concluded in 1982 and its exploitation shall be based on the principle of the common heritage of mankind(CHM).This legal system is a centralized exploitation and redistribution system that the International Seabed Authority represents as a representative of human kinds in the Area.Under the resource-concentration development system,the State Party or other entities are obligated to share the benefits from the resource exploitation in the Area under the guidance of the Authority,and the core of this process is the benefit-sharing mechanism.Based on this background,the paper starts with the core CHM principle which is guiding the development of resources in the international seabed Area and demonstrates the theoretical basis of the benefit sharing mechanism and the current practice.It illustrates the importance and the realization path of benefit sharing in Area resource development,combining the views of Stakeholders.to the paper looks at China's position and development strategy on the issue of deep-sea international rulemaking and benefit sharing,so as to explore the path for China's participation in the global governance of international seabed resources exploitation and development.
