3D bioprinting of human organs is produced with the development of 3D printing technology,biotechnology and medical technology.From printing a section of blood vessels and tissues to printing large organs such as breathable lungs,3D bioprinting technology is constantly making contributions to human medicine and bring hope of life to patients who are waiting hard for organ donors.As a new thing,3D printing human organs are almost in the legal blank all over the world.It brings challenges to the law as well as technological progress and benefits to mankind.At present,there is no clear stipulation about its legal attribute and right ownership in China.Firstly,this paper starting from the legal problems brought by the technical background of 3D printing human organs,the practical value and practical significance of studying the attribution of the rights of 3D printing human organs are proposed.Secondly,this paper clarifies the legal attributes of 3D printing of human organs,and clarifies the legal attributes from the comparison with the relevant special objects,and points out the existing problems in the ownership of 3D printing of human organs in China,and then analyzes the foreign countries.Finally,this paper puts forward the countermeasures to solve the problem,which will be helpful to the 3D printing of human organs in practice.This article is divided into five parts:The introduction part mainly introduces the technical background and technical concepts of 3D printing human organs,the moral and legal dilemmas it faces,and then introduces the theoretical value and practical significance of the research in this article.In addition,it also discusses the current status of domestic and foreign research on the patentability of special objects and 3D printed human organs,which lays the foundation for the development of the paper.The first chapter is the legal attributes of 3D printing human organs.In this part,through the definition and analysis of objects and personalities,and through the analysis of relevant theories about 3D printing of human organs in China and abroad,finally through comparative analysis,3D printed human organs should be defined as"personality".After clarifying the legal attributes of 3D printed human organs,it lays the foundation for the following analysis of their rights.The second chapter is the current status of the rights of 3D printing human organs in China.This part points out the legislative status and existing problems of China's 3D printing of human organs.The attribution of 3D printing human organs rights is unclear and the disposal of remaining organs.The current status of the problems is analyzed.The third chapter is the current status of foreign 3D printing human organ rights.By analyzing the advantages and limitations of the legislative status of the United States,Germany,and the United Kingdom,with a view to drawing on experience from other regions,we propose a solution to the problem of attribution of 3D printed human organ rights in line with China's national conditions.The fourth chapter is the solution to the problem of the attribution of the rights of 3D printing human organs in China.Based on the analysis and discussion of the first three chapters,it puts forward suggestions that are in line with our national conditions,formulates and revises relevant laws and regulations,clarifies the attribution of the rights of 3D printing human organs in different situations Better promote the development of this technology and solve practical problems.
