Study On Safety And Security Obligations Of Sports Organizers

With the development of sports,more and more people begin to pay attention to the personal safety of sports.How to treat the inherent risk in sports activities correctly and how to deal with the imputation problem in sports activities correctly are the problems to be solved urgently in current judicial practice.However,after the occurrence of damages,all parties are faced with the problem of liability distribution and damages.However,the current laws in China cannot properly solve this problem.Different judges have different legal bases for judging such cases,and the judgment results are quite different.The first part of this paper is to analyze and summarize the judicial cases of China judicial documents network.Firstly,the source of samples and research questions are introduced,and then the statistics of sports organizers' responsibility for security are introduced.It is introduced from the types of cases,the distribution of infringement causes,and the responsibilities of the organizers of sports activities.Finally,the types of organizers of sports activities are summarized according to judicial cases.The second part: elaborate the basic theory of the safety and security obligation of the organizers of sports activities.This part through the analysis of the infringement of sports activities in recent years in the last part,so as to clarify the legal provisions,legal relations and the main content of the security obligations of the organizers of sports activities.Part three: the legal responsibility of the organizer of sports activities.This paper discusses the principles of imputation,constitutive elements and causes of hindrance of liability.This paper analyzes the principle of imputation in the system of tort liability law of our country at present,and expounds from multiple perspectives the behaviors of violation and damage caused by fault identification,violation of duty of care and violation of safety and security obligations of the organizer,including the liability under the intervention of a third party.A large number of related judicial practices in recent years are introduced to find and solve problems in practice.Part four: the perfection of the safety guarantee obligation of the organizers of sports activities in China.This paper gives some Suggestions from four aspects:clarifying the reasonable limits of the security obligation,perfecting the security system of the security obligation of the organizers of sports activities,strengthening the standard of the system of the security obligation of sports activities,and reasonably setting up the principle of imputation and responsibility bearing.
