On The System Of Spousal Support In China

The divorce relief system stipulated in the marriage law of the People's Republic of China issued in the new century includes three relief methods: divorce economic assistance,domestic work compensation and divorce damage compensation.Among them,the divorce economic assistance system has the similar relief function with the spousal support system implemented in overseas.Although China's economic assistance system has been implemented for 18 years,its effect is not ideal.Today's "two child" policy also makes some women have obvious disadvantages in employment.In most families,women give up or reduce their employment to take care of the family.Therefore,in divorce,the protection of the interests of vulnerable groups in marriage has become an important way to achieve social equity.In view of the disadvantages of the current divorce relief channels in China,in the process of comparing and learning the overseas divorce relief channels,the spousal support system can play a more important role in the purpose and nature of the relief of the vulnerable party.On the other hand,the spousal support system has been tested and applied for a long time in foreign countries,and its system has been relatively complete.Compared with C hina's divorce economic assistance system,its specific provisions in the system are also more detailed and strict,including the types of support,the conditions for obtaining the support fee,the period and amount of payment of the support fee,the payment method,the change and termination of the support fee,etc.,and its judicial application will be more legal.According to the methods of literature research and comparative study,this paper makes a systematic analysis of the spousal support system.In the first chapter,the author introduces the concept of spousal support system in detail,as well as the nature and existing basis of spousal support system;in the second chapter,the author introduces the provisions of China's divorce economic assistance system and the shortcomings of the system compared with the spousal support system;in the third chapter,the status of spousal support system in foreign countries,Hong Kong,Macao and Taiwan,including the payment standards of support fees,changes The fourth chapter is the specific matters that should be considered when establishing the spousal support system.
