Study On The Protection Of Labor Rights And Interests Of Domestic Workers

With the rapid development of the domestic service industry,the number of employees in the domestic service industry has increased year by year,and the labor rights protection of domestic workers has begun to become prominent.Under the existing legal system,the employment of family and person is not covered by the labor law,and domestic workers cannot receive the labor protection measures stipulated in the labor law,including minimum wage standards,statutory leave,participation in work injury insurance,labor inspection protection,Labor arbitration and performance guarantee rights.In addition,the legal system regarding domestic workers' participation in social insurance,vocational skills training,labor inspection protection,legal aid,organization of industry associations,and regulation of the employment environment is not yet complete.This article analyzes the existing legal regulations and typical cases,and combines relevant foreign legal regulations,and states that domestic service activities that have a certain personal and economic dependency should be recognized as labor relations,and the corresponding employment forms should be included in the scope of labor law protection,and related Legal security system.Aiming at the problems raised and the legal practice at home and abroad,the article finally puts forward countermeasures and suggestions on improving relevant laws and regulations.
