| As China’s economic development enters the fast lane,the practical significance of trademarks gradually emerges in the development of the market economy.The number of registered trademarks in China is increasing day by day,and the situation of waste of trademark resources is becoming more and more serious.The establishment of a registration trademark non-use revocation system can alleviate the waste of trademark resources to a certain extent and correct the trademark owner ’s non-use of registered trademarks.However,since the details of the withdrawal comprehensive system of regulation is not applicable confusion in judicial practice process.Based on this,the author starts the discussion on the registration trademark non-use cancellation system as the core,clarifies the relevant basic theories,compares it with the experience outside the region,points out the inadequacies of the system,and puts forward suggestions for perfection in line with our national conditions.This article uses literature research,case analysis,comparative analysis and other research methods to analyze and discuss the registration trademark not using the revocation system.The full text consists of four chapters,and studies the system of non-use of registered trademarks in China from different angles.The first chapter of this article expounds the basic theory of the registration trademark non-use cancellation system,defines the concept of the registered trademark non-use cancellation system;summarizes the outstanding features of the system;and discusses the role of the registered trademark non-use cancellation system.The second chapter mainly focuses on the experience of extraterritorial experience,separately elaborates the relevant provisions of Japan,the United States,Germany,and Canada on the use of the cancellation system of registered trademarks,and horizontally compares the experience of other countries ’systems to make the analysis of the shortcomings of China ’s system bedding.The third chapter takes China’s registered trademark non-use revocation system as the main body of analysis,and analyzes the actual situation of China’s registered trademark non-use revocation system.In terms of the power confirmation system,specific regulations on use,the justified reasons for preventing the revocation of registered trademarks,and the procedure settings Explore the shortcomings of theexisting system.Chapter Ⅳ addresses the shortcomings of China’s registered trademark non-use cancellation system,and puts forward targeted improvement suggestions,and strives to improve China’s registered trademark non-use cancellation system,and promotes the construction of China’s socialist legal system. |
