Research On Juvenile Justice Administration In The View Of Restorative Justice

Juvenile justice is an unavoidable issue in criminal justice.As a special group of society,juvenile delinquency shows different characteristics from adult crime,and juvenile justice is naturally different from adult justice.With using restorative justice to deal with juvenile delinquency becoming the trend of the world,restorative juvenile justice has entered the research field of vision of all circles in our country.The proposition of restorative justice opens a new direction for the development of juvenile criminal justice.Through dialogue and understanding between victims and perpetrators,juvenile perpetrators can sincerely repent and return to society smoothly.Although China has not affirmed the inherent agreement between restorative theory and juvenile justice in the form of legal texts,it has tried to integrate restorative factors into the specific system injudicial practice to a certain extent.In addition to the introduction and conclusion,this paper is mainly divided into four parts:The first part introduces the concepts and main characteristics of juvenile justice and restorative justice respectively,points out their value and function compatibility,and puts forward the necessity of introducing restorative concept into juvenile justice.The second part mainly discusses the current situation of juvenile justice in our country from the aspects of concept,mode and procedure design,as well as the attempt of restorative concept in the field of common criminal justice in our country.It puts forward the deficiency of restorative theory in the application of specific system,and then discusses the feasibility of introducing restorative justice into the field of juvenile justice from the practical results of restorative justice.The third part mainly summarizes the experience of restorative juvenile justice in the United States,France,New Zealand and Japan,and analyses the characteristics of reconciliation and transfer of restorative juvenile justice in foreign countries,so as to provide useful reference for restorative juvenile justice in China.The fourth part focuses on three aspects:legislative direction,system design and mechanism assumption,emphasizing the comprehensive design of specific procedures,diversification of treatment means,broad participation of the main body,and diversification of mechanism settings of restorative juvenile justice,and putting forward a reference scheme for the construction and improvement of restorative juvenile justice in China.
