Research On The Protection Of Patients' Personal Information Rights In Medical Big Data

This article starts with the case,first of all,using Cai and other 8 people to complain about the case of the Central Health Insurance Department of the Ministry of Health and Welfare in Taiwan,that is,in the context of medical big data,the use of patient medical health information represents the interests and patient personal information.Disclosure has led to conflicts in the right to personal information,and the purpose of this paper is to document how to protect the patient's personal information rights while balancing public interests in medical big data.The full text is divided into five chapters.The first chapter is the introduction part of this paper.It analyzes the background and significance of this paper,summarizes the research situation at home and abroad,and summarizes the research methods,innovation points and insufficient support.The second chapter defines the basic concepts of this paper,analyzes the background,basic characteristics and influence of medical big data on patients' personal information rights,and then demonstrates the legal attributes and legal basis of personal information rights,and the patient's personal information rights in medical big data.The logical layer system is initially analyzed.The third chapter is the argument part of this paper.It discusses the basic content of patients' personal information rights,and analyzes the necessity of restricting patients' personal information rights in medical big data to balance the protection of patients' personal information rights and protect public interests.The fourth chapter conducts comparative law research,analyzes and summarizes the laws on the protection of patients' personal information rights in extraterritorial countries and Taiwan,and provides methods and ideas for protecting patients' personal information rights in China.The fifth chapter proposes countermeasures to improve the patient's personal information right in medical big data in China.Based on the previous analysis,combined with the problems in our practice,the corresponding solutions are proposed.
