Under the existing tort law system,there are theoretical obstacles in determining whether the manufacturer's product liability or the driver's fault liability is recognized in the automatic driving accident.Among them,some of the obstacles belong to the difficulties of the court's practice,such as judging the design defects,warning obligation,and driver's duty of care;the other part belongs to the gap in the legislation,such as artificial intelligence civil status.At present,scholars have proposed theories such as public carrier theory,animal tort theory,distinguishing driver's transferred power,and no-fault liability.This paper holds the view that the liability should be determined in accordance with the three levels of semi-automatic driving,high-automatic driving and full automatic driving.As for the compensation phase,a supportive insurance system and social public fund system would be important to solving the problem of damage compensation for automatic driving accidents.
