On The Construction Of Plea Bargaining In The System Of Lenient Sentence For Admission Of Guilit And Acceptance Of Penalties

The system of lenient sentence for admission of guilt and acceptance of penalties has been a research hotspot since its establishment.There are lots of works to do to achieve a perfection of the system,and one of them is constructing a Chinese-style plea bargaining.In this paper,plea bargaining in the US,Italian patteggiamento and criminal negotiating procedure of Taiwan province will be introduced and analyzed.Based on them,the paper,on the one hand,focuses on the concept of the procedure and its connection with other systems,and on the other hand,investigates the launch of the procedure,negotiated contents,the review by the judge and other specific problems.Hopefully,the study will provide some helpful advice and promote the construction of plea bargaining in China.
