With the promotion of the awareness of civil rights,the awareness of patients' rights in the relationship between doctors and patients is also increasing.The most important aspect of patient rights is the patient's right to informed consent.The patient's right of informed consent reflects respect for the patient's autonomy.However,the emergency treatment system reflects the characteristics of urgency,giving medical institutions the right to break informed consent in emergency situations,which will inevitably lead to the collision of the two systems.However,both of these systems are indispensable for protecting patients' right to life and health.The informed consent system ensures that patients are aware of risks by guaranteeing the right to self-determination,and the emergency treatment system ensures life and health by guaranteeing the right to treatment.Although the two conflict,the purpose of protecting life and health is the same.How to balance the emergency treatment system and the informed consent system is the content of this article.In addition to the introduction,there are three parts:The first part mainly introduces the relevant concepts and characteristics of the emergency treatment system and the informed consent system.Through the description of the characteristics of the emergency situation,the differences between informed consent in emergency situations and the unified informed consent are discussed.Informed consent sets the stage.The second part mainly introduces the dilemma of the realization of the two rights caused by the conflict between the emergency treatment system and the patient's informed consent system.Introduce cases to introduce the dilemma of the informed consent system in emergency situations.This part mainly introduces the flaws of legal norms and discusses the problem of medical institutions neglecting to implement emergency treatment measures in emergency situations.The third part is a few opinions on the current predicament and current situation.Through the study,it was found that in emergencies,blindly emphasizing the patient's informed consent would adversely affect the patient's right to life and health.Therefore,the author draws on the emergency diagnosis and treatment,and applies the informed consent system in emergency situations.It also draws on the experience of other countries and hopes to promote the advance medical instruction system in my country to ensure that patients can more fully enjoy the patient's informed consent system and reduce abuse of the right of informed consent by close relatives in emergencies.
