There are specific provisions in the branch law of the economic law to regulate false propaganda behavior,it should be said that China has established a relatively complete and sound legal system for the regulation of false propaganda.However,if we believe that the regulation of this behavior has achieved satisfactory results,administrative law enforcement and judicial litigation have no institutional and procedural obstacles,it is obviously that the conclusion of this causal derivation is not convincing.Meanwhile,false propaganda behavior in the new situation presents new characteristics and new problems.Therefore,it is necessary to review the implementation of the current legal system for regulating false propaganda behavior,evaluate the implementation effect,and further enhance the regulatory effect of false propaganda behavior.Based on these problems,the research is mainly divided into four sections.The first section is based on the legal texts regulating false propaganda behavior,focusing on investigating the current constitution of the legal system for regulating false propaganda behavior in China.The second section is to examine false propaganda behavior legal system can realize consumer protection and maintain the public competition order.The empirical research results show that the regulation effect of false propaganda behavior is not effective enough,the protection of consumer rights is insufficient and the incentive for consumer participation is inadequate.The third section is to further analyze the rationality of consumer enforcement,from the concept of "Homo economicus" in economics to the concept of "consumer" in economic law,and to point out the predicament of current consumer participation in false propaganda behavior.The fourth section is to put forward the rationalization proposal that promotes consumer to participate in false propaganda management from the three micro-levels of legislation,law enforcement and justice,and from macro-level,the role of a good legal environment.
