Discussion On The Application Scope Of Notarial Obligatory Right Document

Notarial Obligatory Right Document,with its advantages of efficient,convenience,low-cost,consensual execution,has attracted more and more notary parties to choose it to defend their rights.With the deepening of economic engagement and increasing of financial needs,the application scope of notarial obligatory right document has expanded.The limitation of the application scope by the legal interpretation brings certain risks,and the notary parties avoid to choice it as a way to preserve the rights,which is a disadvantage to the benign development of the system.Therefore,it is of great significance for the function improvement of the system to interpret the concept and characteristics,understand its normative significance and define the application scope appropriately.The paper based on notary theory and civil laws,combined with transformation of notary institution and the procedural value of notarization system,to comprehensively and systematically analyze the application scope of notarial obligatory right document as a normative interpretation.The full text is divided into four parts.The first chapter tries to find out the reasons for variation of the application scope and value shift on the basis of introducing the origin and situation of notarial obligatory right document.The second chapter combs the different facts and debates of the application scope,points out that the scope of application is subject to the value and purpose of different jurisdictions.The third chapter puts forward the definition of notarial obligatory right document to be interpreted as norms,for this purpose analyzes its concept and characteristics,and tries to explore the normative significance of the system.The fourth chapter tries to define its scope,and suggests that the notarial obligatory right document should be limited to the intended debt to be paid for the disposition of property.
