| The maritime Administration,known as the “maritime traffic police”,is the competent authority in charge of crew management in China.As a law enforcement agency for the study on policies and regulations of seafarer and supervision on on-site performance of seafarers,China MSA has a larger number of crew members on official ships with orderly ship types.These crew members have responsibilities including on-site cruising,emergency search and rescue,maritime rights protection,etc.The management of public service crew members of the Maritime Safety Administration should become a model benchmark in China’s crew management.The public service crew members should guide the way in the maritime industry in comprehensive qualities such as industry technical specifications,laws and regulations,ethics and professional style.Working in the public sector,they should build a relatively stable team on social security,whose crew members are different from the ordinary ones.However,due to multiple factors such as history,internationality,and concepts,our country has lagged behind advanced shipping countries in legislation of seafarers.For many years,there have been few special laws and regulations in the management of public service crew members.Regulations from crew management regulations to social security management regulations are incomplete,scattered,lower-ranking and marginal.Excluded by international conventions and domestic crew regulations converted from international conventions,these regulations are in an embarrassed position in the management of public service crew members with “legal support”.With the development of the strategy to strengthen its maritime power and transportation power,the research and construction of crew management laws for public service ships are very necessary.This article analyzes the historical development and current status of legislation of maritime public service ship management in China,exemption from international conventions for official ships,The management on public service ship in China andmanagement on public service ships in America,China Hongkong and Japan.This paper focuses on the specificities of crew members on maritime public service ships compared with other occupations,identifies the root causes of the problem that the construction of laws and regulations are not proportional to the particularities of the duties,and combining reality with future,and proposes suggestions on the revise of international conventions.It is necessary to vigorously promote the legislation on crew management,the introduction of the "Seafarer Law" and the supporting regulation system of the public service crew members on the official ships,and establish a high-precision,strict,comprehensive,specific and feasible regulation system for management of public service crew members.Proceeding from reality,we will redesign and adjust the entire career process including career entry,training,examination,certification and promotion,and the protection of crew rights and interests in a forward-looking and predictive manner,aiming to provide a comprehensive legal guarantee for the healthy development of the public service crew member team and provide excellent human resources for our government. |
