Investigation And Research On The Administrative Public Interest Litigation Initiatde By The Procuratorial Organs Of Guangdong Province

Public interest litigation is a new task under the background of China's current reform of judicial system,and also a new focus and highlight of the work of procuratorial organs after the adjustment of procuratorial functions.The research object of this paper is administrative public interest litigation.The administrative public interest litigation of procuratorial organs has strong practical significance and plays an important role in promoting the performance of administrative organs according to law,protecting public interests and responding to social concerns.In July 2015,the standing committee of the National People's Congress authorized the supreme people's procuratorate to carry out trials of public interest litigation,and Guangdong province was designated as one of the pilot provinces.The Guangdong provincial people's procuratorate has designated six municipal procuratorial organs,including those in Guangzhou and Shenzhen,as pilot procuratorates.In July 2017,the public interest litigation system was introduced nationwide,and the procuratorial organs of Guangdong province carried out public interest litigation work comprehensively,accumulating rich practical experience.In this context,this paper analyzes the relevant data collected from the public channels to study the characteristics of administrative public interest litigation in Guangdong.This paper probes into the restrictive factors in the field of administrative public interest litigation in China,and finds out the reasons in the scope of accepting cases,clue collection,investigation and verification,judicial expertise,pre-litigation procedure,implementation supervision,team construction and other aspects.Finally,some Suggestions are put forward for improvement.
