On The Promotion Of The Legality Of Administrative Litigation To The Government Administration According To Law

The review of the legality of administrative litigation is the core part of the theoretical research on administrative litigation and the basic principle of the administrative procedure law of the People's Republic of China.The method was established for more than 30 years,review of legality of administrative lawsuit to the people's court trial principle,not only in ensuring the judiciary justice trial right,safeguard the legitimate rights and interests of administrative relative person plays an important role,also in supervision,and promote the government administration according to law has played an indispensable positive role.Professor luo haocai once said,"judicial review is one of the most reliable and effective legal systems to 'supervise' the administration of the government according to law through strict judicial procedures." In recent years,the legitimacy review in administrative litigation is the perfection of closely related with the development of democratic rule of law in our country,the rule of law to promote the various legal system constantly improve,with the concept of law to govern the country gradually thorough popular feeling,and judicial review is to supervise whether the idea in place,visible in the administrative proceedings legitimacy on the government censorship has a great role in promoting administration according to law..However,the current review of the legality of administrative litigation still has certain limitations in the supervision and promotion of government administration according to law,such as the narrow scope of the review,the review effect is not good,the review intensity is not in place.This paper studies the relationship between the legality review in administrative litigation and the government's administration according to law,and puts forward the problems existing in the connection between the two,so as to better guarantee and promote the government's administration according to law by improving the legality review system of administrative litigation.
