Research On Investigation And Processing Mechanism Of Drug-related Assets

In recent years,the public security organs and financial institutes work together from investigating drug-related assets,seeking clues to recovered drug-related capital,cracking down the drug crime from upstream to downstream so as to ban drug and fight against drug smuggling.However,in practical for various reasons the public security organ just solves complicated cases,tracks down gangs and disrupts the network,but not further recovers drug-related capital,digs out clues and anti-money laundry,which is not a thorough strike on drug crimes covering all chains and links.Investigation and punishment of drug-related assets have not been defined yet.The operation mechanism is not smooth.It requires the improvement of the methods and measures of each step and in-depth research and exploration of relevant laws and theoretical foundation to establish a reasonable mechanism to investigate and punish drug-related assets.Therefore,a comprehensive study of this mechanism is a realistic requirement when facing the new situation of drug crime and finding new ways of drug control and new means of drug enforcement,as well as a inherent demand for the public security organ to strengthen the capability of suppressing drug crime and the effect of enforcement.Firstly,this paper introduced the background,significance,current situation,methodology,innovative and complicated points of the research.Secondly,it presented an overview of the investigation and punishment mechanism of drug-related assets,including the notion of drug-related assets,the definition and evolution of investigation and punishment of drug-related assets,and the definition of this mechanism.Thirdly,it analyzed the current situation of investigation and punishment of drug-related assets in China and existing problems and weakness,such as incomplete laws and regulations,decentralized mechanism and difficulties in capital recovery and cross-border investigation and punishment of drug-related assets.Fourthly,it explained the current situation of investigation and punishment of drug-related assets in the US,Australia,Hong Kong and Taiwan and its reference meaning to China.Finally,on the basis of the current situation of investigation and punishment of drug-related assets in home and abroad and further study of existing problems and insufficient research in China,this paper proposed such solutions as rational distribution of the burden of proof,strengthening evidence collecting through investigation of involved finance,in-depth practice of investigation and punishment of drug-related assets,standard supervision system,extensive means and complete cooperation mechanism of police affairs,thus creating a perfect comprehensive investigation and punishment mechanism of drug-related assets.
