Research On The Types Of Public Security Administrative Penalties

In China,the law on public security administration and punishment is an important law on which public security organs handle public security cases.The current law on the administration and punishment of public security has played an important role in maintaining public order,ensuring public security and protecting the legitimate rights and interests of citizens,legal persons and other organizations.However,it is undeniable that the law on public security management and punishment has been promulgated and implemented for more than 10 years since 2006.Although it was revised in 2012,some of its contents have been unable to meet the needs of public security law enforcement practice.This paper mainly studies the types of public security administrative penalties against the background of public security administrative penalties system.The introduction of this paper briefly expounds the relationship between the public security management punishment law and the generalized public security management punishment,and the significance of perfecting the public security management punishment law.The text is divided into five parts: the first part is an overview of public security administrative penalties,mainly including the definition and classification of the types of public security administrative penalties,the comparison between the types of public security administrative penalties and related types,and the historical evolution of the types of public security administrative penalties in China;The second part is the evaluation and analysis of the practice operation of the types of public security administrative penalties,respectively analyzing the existing problems in the current legal types of law enforcement practice and the embarrassment of dealing with the new problems of public security;The third part is the investigation and reference of the punishment for the behavior violating the social order outside the region,including the introduction of the types of punishment for the behavior violating the social order in Japan,Germany,Taiwan and other civil law countries and regions,as well as the reference of China.The fourth part is aimed at the second part of the law enforcement practice to improve the problems;The fifth part is on the basis of referring to the relevant systems outside the region,combining with the existing research results of Chinese scholars,according to the principle of risk prevention of China's existing types of punishment to supplement Suggestions.In this paper,from the perspective of law enforcement practice at the grass-roots level,to maintain social order,public security,for the purpose of protecting the legal rights and interests of citizens,legal persons and other by public security administration law enforcement practice in recent years hot or new problems of carding,analysis,put forward the Suggestions for the perfection of administrative penalties forpublic security penalties existing species,as well as the safety problems in response to the new punishment kinds of supplementary Suggestions,in order to improve the system of administrative penalties for public security in China provide certain theory reference and reference.
