Research On The Legal Issues Of Copyright In The Live Broadcast Of Online Games

The rapid development of science and technology,while enriching life,also brings great pressure to the public.Online games have the characteristics of entertainment,convenience,interaction,decompression and so on,which adapt to the needs of the times and are highly sought after.The rapid development of online games has promoted the rise of live broadcast of online games,created considerable economic benefits,and also caused many copyright infringement problems.But for these problems,our law has not made clear provisions.Therefore,this paper explores the problems and solutions faced by the online game live copyright.First of all,this paper introduces the concept and development of live network game,and then expounds the provisions on the copyright of live network game in China,lists the existing legal provisions on live network game in China,and questions the copyright of our country by quoting relevant judicial cases on the screen properties of online game,the reasonable use of live network game and the superiority of copyright law over unfair competition law Analyze the questions.Next,it puts forward four legal issues: the unclear identification of the work attributes in the live broadcast of online games,the dispute on whether it should be included in the reasonable use,the serious infringement phenomenon in the live broadcast of games and the ownership of copyright,It focuses on the infringement and summarizes the enlightenment to our country through the research on the provisions of the live broadcast copyright of online games in foreign countries.Finally,from the aspects of legislation,improving the proof system of online game live broadcast litigation,Introducing Punitive Compensation and improving industry self-discipline,the four sides provide legal advice to improve the copyright protection in online game live broadcast in China,hoping that these will play a little role in solving the disputes of online game live broadcast right and promoting development of online-game living broadcast.
