Research On Legal Issues Of House Expropriation And Compensation In Shanty Towns On State-owned Land

The acquisition and compensation of land and housing in China was of great significance in 2011.In this year,the Regulations on the acquisition and Compensation of Houses on State-owned Lands(hereinafter referred to as the "Regulations")were passed smoothly.The adoption of the "Regulations" provided a sound legal basis for the acquisition and compensation of houses on state-owned land,and provided a more complete legal guarantee for land expropriated persons.Since the 40 th anniversary of the reform and opening up,the rapid development of China's social economy and the vigorous promotion of shantytown renovation by Chinese government in recent years,China's land expropriation and compensation for land has gradually encountered some problems that are incompatible with the Regulations,herefore,the legal analysis of related issues on the acquisition and compensation system for houses on state-owned land is particularly important.This thesis adopts the method of case analysis and comparative study to analyze the existing problems of housing expropriation compensation in the shantytown renovation through several cases in legal practice,mainly including the unreasonable principle of housing expropriation compensation,the unreasonable compensation standard,the single compensation method,the narrow scope of compensation,the lack of detailed procedures of expropriation compensation,etc.Based on this basis,the thesis studies and draws on the successful experience of foreign relevant systems,and puts forward corresponding suggestions from the aspects of the principles of expropriation compensation,compensation standards,compensation methods,the selection mechanism of evaluation institutions,the scope of expropriation compensation and compensation procedures,so as to further improve the compensation system of housing expropriation on state-owned land in China,give more complete protection to the expropriated and promote smooth implementation of relevant laws and regulations.The paper has 6 figures,4 tables and 87 references.
