Research On Visiting Right System

In recent years,divorce cases have increased gradually in our country.In order to better protect the rights and interests of the minors,when the Marriage Law of the People's Republic of China(hereinafter referred to as the "Marriage Law")was amended in 2001,the visitation right system in our country was established in the law for the first time.This system not only better protects the legitimate rights and interests of the minors,protects the parental rights between parents and children,but also improves the family marriage system in our country,which provides relevant legal basis and institutional guarantee for handling visitation disputes in judicial practice.However,there are still various deficiencies in our country's regulations on visitation rights in practice.Because the subject of rights and obligations of visitation rights is not clear,the reason for suspension of visitation rights is too general,and the way of exercising visitation rights is not clearly defined,so that there are various difficulties in the process of implementation.Difficulty in enforcement is the biggest challenge in our judicial practice.Therefore,in view of this series of problems,China's relevant regulations on visitation right should be further improved and the visitation right should play their due role in the best interests of children.
