An Empirical Study On The Social Investigation Of Juvenile Criminal Cases By The Procuratorate Of District K,City B

This study takes the judicial practice of the procuratorial organ in District K of city B as the starting point,adopts the method of empirical research,through a systematic and comprehensive analysis of the practice of the social investigation of the juvenile criminal cases of the procuratorial organ in District K of city B,it is found that there are some problems in the judicial practice of district K of city B,such as the simplification of the investigation subject,the inconsistency of the investigation scope,the irregularity of the content and form of the investigation report,and the time of investigation There are many problems,such as the obvious lag and the lack of attention paid by the judges to the investigation results,which seriously affect the positive role of the system itself.The problem stems from the fact that there is no unified investigation form in the social investigation report of K District of B city,the investigation subject is criticized,focusing on the Procuratorate's self investigation,the content of the investigation is limited,mainly based on the fact description,and lack of analysis and Discussion on the problems,the social investigation at the trial stage lacks the attention of the judge,and the procuratorate and the court do the same or similar to the minors involved in the crime at the same time.There is no lack of investigation in the social survey report.And further put forward targeted suggestions on improving the social investigation system of juvenile criminal cases in China.The procuratorates of K District of B city can use procurement services,introduce some social forces to participate in the investigation and accept the entrustment of the procuratorial organ.In the investigation contents,further strengthen the reasoning in family education,personal physical and mental aspects,Juvenile Socialization and before and after the crime In order to better take it as a strong basis for conviction and sentencing;set up juvenile justice system and institutions,improve the legal connection between lawyer inquiry and parole.In order to help minors involved in crime to better carry out effective correction,so that they have confidence in life again.
