Research On Standardization Of Personal Information Collection By Public Security Organs

The use of personal information by public security organs to complete law enforcement and other police work has become an indispensable way of law enforcement and working methods,and future police activities will rely more on personal information.Collection of personal information is a pre-program for personal information utilization.The completion of personal information collection is directly related to whether personal information can be successfully applied to public security work.However,the current collection of personal information by public security organs is not optimistic,and there are some problems,which not only affect the efficiency of personal information collection,but also threaten the information rights and interests of information subjects.Therefore,in order to improve the efficiency of personal information collection and protect personal information rights of citizens,it is urgent to systematically analyze the standardization of personal information collection in public security organs from the perspective of legal system construction.This paper analyzes and demonstrates the construction of standardization of personal information collection in public security organs through literature research and comparative research.The article is divided into four parts:The first part is an overview of the collection of personal information by public security organs.Starting from the definition of personal information,the historical evolution and legal basis of the collection of personal information by public security organs,the purpose of the collection of personal information by public security organs,the types and ways of the collection of personal information by public security organs,and the categories of the collection of personal information by public security organs,this paper clarifies the basic concepts of research objects.The second part is about the problems existing in the collection of personal information by public security organs.The current problems mainly lie in: first,the implementation of legal principles is not in place.Second,the legal basis is not perfect.Third,personal information storage security risks exist.Fourth,information sharing between government departments is not smooth.The third part is the analysis and supervision experience of the main extraterritorial legislation modes of personal information collection.The paper comments on the two major extraterritorial legislative models of decentralized legislation and unified legislation,and summarizes the overseas supervision experience.The fourth part is the standardization construction of personal information collection by public security organs.The author puts forward that firstly,the legislative model should beestablished.The second is to construct the legislative principles,which includes eliminating the dilemma of informed consent principle,observing the principle of proportionality and the principle of legal priority,and applying the principle of legal reservation in different categories.The third is to establish legislative rules,which includes clarifying the authorization of public security organs to collect personal information,standardizing the procedure of public security organs to collect personal information,and establishing the complete relief path.The fourth is to establish reasonable protection mechanism.The fifth is to establish a perfect supervision system.The sixth is to improve information sharing among government departments.The seventh is to explain and publicize the protection of personal information to the public.
