Research On The Boundary Of Penalty For Administration Of Public Security From The Perspective Of Social Governance

The boundary rules in the field of law reflect that the law can only regulate human behavior within a certain range.As the punishment method prescribed by law,penalty for administration of public security is bound to be restricted by the border.The so-called penalty for administration of public security boundary refers to the category and limit of penalty for administration of public security.This boundary contains two meanings.On the one hand,it is the division of penalty for administration of public security and other punishments,which is the externality of the punishment boundary;On the other hand,as a kind of administrative punishment power,the penalty for administration of public security is the punishment of the rights of those who violate the law and order.The exercise of the power of punishment involves the boundary between the rights of citizens and civil rights,which is the internality of the punishment boundary.At this stage,the lack of basic principles and emptiness in the implementation of penalty for administration of public security,imperfect types of punishment,and other issues arise from the failure to correctly determine the boundaries of penalty for administration of public security.Therefore,under the current background of social governance,we should reorganize the boundary of penalty for administration of public security and punishment in combination with social governance theory,and further improve the boundary elements and public security management and punishment system by analyzing the internal and external factors of the boundary,which is of great significance to protect the legitimate rights and interests of citizens and maintain social stability.This article is divided into six parts: The first part describes the research background,research significance,domestic and foreign literature reviews,research methods,research ideas.The second part mainly elaborates on the proposition of the concepts of social governance,boundary theory,and penalty for administration of public security boundary,and points out the impact of the definition of penalty for administration of public security boundary on the penalty for administration of public security system,and innovatively analyzes the penalty for administration of public security from the perspective of legal boundary.The third part is an indepth analysis of the internal and external elements of the penalty for administration of public security boundary,and horizontally discusses the profound impact of the penalty for administration of public security boundary elements on the penalty for administration of public security system.The fourth part,a longitudinal analysis of the changes in the boundary of penalty for administration of public security,combined with the corresponding background,discusses the changes in the boundary of the penalty for administration of public security law in different historical stages,and provides a theoretical basis for the analysis of the boundary lements of the current penalty for administration of public security law.The fifth part compares the "Social Order Maintenance Law" in China's Taiwan region,starting with its development process,boundary changes and other contents,and compares it with the "Penalty for Administration of Public Security Law" to provide a reference for the reform of the penalty for administration of public security system.The sixth part is to look at the perfection and standardization of the penalty for administration of public security system from the perspective of the legal boundary.From the perspective of legislation and law enforcement,combined with the new concept of social governance,it specifically puts forward ideas for improving the penalty for administration of public security system and suggestions.
