Research On Detention Inspection System In Detention Houses In China

As an advanced system in foreign countries,detention place inspection system was introduced into China,aiming to play its unique role in supervision,to protect the rights of detainees and improve the credibility of law enforcement.In 2008,in Liaoyuan detention center,the inspection system of detention places was first tested and applied and achieved good results;in 2011,the supervision administration of the Ministry of public security officially issued the regulations on inspection and supervision of specially invited supervisors of detention centers,which was implemented nationwide in the form of inspection mechanism of specially invited supervisors;in 2017,the first in the detention center law(Draft for public comment)Article 113 stipulates that a detention house shall employ law enforcement supervisors and establish a system of inspection by law enforcement supervisors.This shows that the inspection system of custody place will be formally established in China in the form of law enforcement supervisor inspection system at the legal level.The inspection system of custody places has developed rapidly in the process of localization in China,but there are also many problems in practice.At this stage,the reform and development of detention center in China has entered a new stage of respecting and protecting human rights.This paper is just to put forward suggestions to solve the problems based on the current practical problems,combined with the relevant theoretical research at home and abroad,and play a positive role in the specific practice of detention center patrol system in China.The main body of this paper is divided into five parts: the first part is the introduction,which mainly introduces the background,significance and research status of the topic.The second part combs the international promotion of the detention place inspection system.The third part is the introduction and promotion of the inspection system of detention places in China.The fourth part is an analysis of the detention inspection in detention centers in China,mainly from the perspective of legal basis and personnel subject.The fifth part is to put forward reasonable suggestions in view of the current detention patrol problems and practice.
