Research On Time-wasting Damage Compensation Of Tourism Contract

Over the recent years,tourism industry has become one of the pillar industries of China's economic development.China's 2019 government work report has raised the development of global tourism to a national strategy and promoted high-quality development of tourism industry with new development concepts.However,different varieties of tourism disputes keep popping up as China's tourism industry flourishes.Tour operator's breach of contract frequently causes a waste of time for tourists,which needs to be resolved urgently.Time is a fixed cost of tourism activities,and it is one of the essential elements in the process of tourism contract implementation.The fundamental aim of the tourists is getting a meaningful vacation.In the era of rapid economic development background,time has exceeded its own meaning and are given a certain value.When tourists' travel experience is not up to expected,a single return of travel costs cannot fully compensate for the time of tourists.Therefore,it makes sense to explore the relief channels of time interest on the basis of existing laws.Beside the introduction part,this article consists of five chapters.The first chapter is “the basic analysis of time-wasting in tourism”.This chapter analyses the relationship between time and travel,time and travel contract,time and tourism contract implementation.It stressed the importance of time factor in tourism activities.And it defines the concept,form and main types of time-wasting in tourism and discusses the non-property damage essence of tourism timewasting.The second chapter is “the status of legislation and justice in China”.It illustrates China's standpoint and attitude in protecting tourists' time interests from both legal and practical perspective,and concludes the existing problems through in-depth analysis of the related legislation and cases.The third chapter discusses the damage compensation system of time wasting in tourism in other countries or regions,and analyzes the advantages and disadvantages of the relevant legislation in other countries or regions through comparative method,so as to provide useful enlightenment for our own country.The fourth chapter elaborates on the necessity and rationality of improving the protection of the time interests of tourism in detail from a theoretical standpoint,which provides necessary basis for introducing the damage compensation system for time wasting in tourism to China.The authors propose predictable rules and the principle of full compensation view to provide a theoretical basis for the time interst protection.The fifth chapter is “suggestions on the construction of China's damage compensation system for time-wasting in tourism”,which puts forward perfect suggestions on the principle of responsibility,the subject of responsibility,the elements ofcomposition and the calculation of the amount of damage compensation,hoping to strengthen the protection of tourists' time interests through legislation,and promote the standardization and legalization of the tourism market.
