P2P online lending platform is the product of traditional financial model and Internet integration under the background of big data era.It is a kind of inclusive finance,relying on the Internet to form a bridge between lenders and borrowers,enabling the realization of transactions.The emergence of P2 P online lending breaks the traditional financing mode,develops a new financing method,greatly reduces the financing cost,and provides a more efficient and convenient financing channel for the development of small,medium and micro enterprises.In the early stage of development of P2 P online lending platforms in China,due to the lack of relevant legal regulations,the phenomenon of "many,chaotic and miscellaneous" appeared.In 2015,the "explosive thunder" of ezubao platform caused the reflection of the regulatory authorities,and a series of regulatory norms such as the interim measures for the management of the business activities of online lending information intermediaries were successively issued.In the past two years,a large number of defective platforms have been withdrawn from the market after the rectification of regulatory authorities.As of the finalization of the author,only over 200 platforms are in normal operation.Taking ezubao as an example,this paper analyzes the legal risks faced by P2 P online lending platforms,reflects on the current status of legal regulation,and proposes corresponding legal regulation Suggestions by referring to the regulatory experience of compliance platforms.In addition to the introduction and conclusion,this paper is mainly divided into four parts: the first part is mainly about the overview of P2 P online lending platform.Secondly,it analyzes the nature of the platform.Thirdly,it lists several operating modes of P2 P online lending platforms.Finally,it sorts out three legal relationships that may be involved in online lending platforms.The second part mainly takes ezubao platform as an example to analyze the legal risks of P2 P online lending platforms from the perspectives of the online lending platforms themselves,the lenders and the third-party institutions.The third part mainly discusses the reflection on the current legal regulations of P2 P online lending platforms in China,as well as the experience of the compliance platform,and concludes the existing problems in the current legal regulations in China,such as unclear regulatory responsibilities,imperfect fund deposit and management system.The fourth part mainly expounds the regulation Suggestions on legal risks of P2 P online lending platforms,and proposes corresponding regulation Suggestions from the legislative perspective in view of the existing legal risks under the existing legal regulation system.
