| Expressway development is an important indicator to measure the country’s economic development,and a lot of stable funds help expressway construction.The PPP mode of expressway has both the public attribute and the profit attribute,which can meet the government’s pursuit of public welfare and the social private capital’s requirement of interests,and can achieve a win-win situation of social and economic benefits.As a developed country,the United States has the characteristics of early development,more investment and large quantity of Expressway PPP mode.This paper collects the relevant legislation,guiding government documents and research cases of expressway PPP in the United States,studies and analyzes the legal regulation of the US.expressway PPP model from the following four aspects: first,from the federal level;second,to establish a national PPP development regulatory agency;third,from the state level,according to the situation of each state Relevant legislative documents have been established.Fourth,the provisions and guidance of PPP franchise contract core guide for toll roads on all aspects of the PPP franchise agreement,including the rights and responsibilities of both parties,risk sharing,project supervision and dispute resolution mechanism.Then it analyzes the two typical PPP mode expressways in the United States,explores the legal regulations,analyzes the experience and lessons,and provides a strong basis for the exploration of the new mode of expressway construction in China.In view of the advantages and disadvantages of the legal regulation of American highway PPP mode,this paper studies and transforms them,and then comes to the Countermeasures of the legal regulation of China’s highway PPP mode:building a perfect and unified legal system;establishing a PPP project supervision institution;using the law to guarantee the risk sharing mechanism;clarifying the dispute resolution mechanism for the performance of franchise agreement.There are 1 picture,1 table and 51 references in the paper. |
