Research On Civil Liability For Human Damage Caused By Artificial Intelligence Products

With the rapid development of artificial intelligence,the related intelligent products gradually enter people's production and life.Nowadays,the most advanced artificial intelligence products even make some behaviors independently,and cause personal and property losses.While we enjoy convenience,we must not ignore the risks brought by artificial intelligence.The application of artificial intelligence products has caused a series of legal problems and has a great impact on the traditional legal system,for China in the stage of full development of artificial intelligence,it is very important to study the related responsibility of artificial intelligence as soon as possible.Because of the working principle of artificial intelligence itself,the esoteric of algorithms and big data,and the controversial "autonomy ",it is obviously different from the product in the general sense.In terms of nature,artificial intelligence and human beings can not and can not be equal,in the legal "personification" attribute also needs to be studied.About the civil law status of artificial intelligence,the reason why it is called artificial intelligence product at this stage is also because artificial intelligence has no civil law subject status for the time being,but it is only a high-end intelligent product,but with the development of artificial intelligence technology,its positioning is still necessary to re-explain.But if artificial intelligence is given the status of civil law subject,then it should also carry on the systematic research to its corresponding rights and obligations and the way to bear the responsibility,and build the complete related legal framework,not just the simple analysis.This paper analyzes the civil liability of artificial intelligence products from five parts.The first part mainly introduces the research background,significance and purpose of artificial intelligence,as well as the current research situation at home and abroad,to lead to related problems.The second part mainly analyzes the meaning of artificial intelligence itself,introduces the development stage of artificial intelligence,and defines the scope of artificial intelligence products causing human damage.The third part studies the controversial issue of artificial intelligence,that is,the legal status of artificial intelligence,and analyzes the possibility and difficulty of artificial intelligence products taking responsibility from the nature of artificial intelligence itself and its "independent consciousness ".The fourth part analyzes the impact of the problem of artificial intelligence products causing human damage on tort liability law and product quality law,and the legal application dilemma that causes the relevant imputation principle.The fifth part introduces the existing types of civil liability for human damage caused by artificial intelligence products,that is,strict liability and alternative liability,and through the analysis of these two types of liability to put forward the relevant suggestions of the way of civil liability,respectively,for the establishment of a special system and the establishment of a special compensation fund way of civil liability for human damage caused by artificial intelligence products.
