In recent years,China's Internet industry has developed rapidly.To date,the Internet has become a very important and indispensable part of the daily life of the public.In the context of the Internet's booming economy,there will inevitably be a variety of ways to compete and many new types of unfair competition will be mixed in them.It is a very important mission of my country's "Anti-Unfair Competition Law" to regulate such newly emerged behaviors with new features and characteristics that are completely different from traditional competitive behaviors.Online video advertising blocking behavior is a new type of competitive behavior that has received much attention in the Internet field..For the time being,in our country,the Anti-Unfair Competition Law does not explicitly enumerate the network video blocking behavior in the second chapter.When solving the related problems caused by the Internet video advertising blocking behavior,It is generally regulated by applying Article 2 as a general provision.In this case,there is not only a very large theoretical difference in the treatment of this issue,such as whether the clause can be applied as a general clause and how it should be applied.There are also different judicial standards in judicial practice.Different judgments and other issues.In this context,this article first analyzes the blocking behavior of online video ads,and analyzes the basic identification logic of general unfair competition behavior.After observing and studying the practice of judicial practice outside the region,summing up the inspiration and reference significance.Then,the focus of disputes on domestic cases and the court's judgment are studied and analyzed.Finally,on this basis,from the two aspects of the regulatory concept and regulatory rules,put forward perfect suggestions for the regulation of online video advertising blocking behavior.The regulatory concept proposes that the court should adopt an inclusive and prudent attitude in handling this issue,reasonably use the principle of neutrality in defense of the situation,and balance the protection of the interests of all parties.Of course,it is protected,the specific recognition standards of recognized business ethics,the impact of the damage results on the recognition,and other four recommendations,which ultimately provide referencesuggestions for the regulation of this issue in China 's judicial practice.
