Research On Information Disclosure System Of Juvenile Offenders

In recent years,the sexual assault minor crime in our country are at higher risk,most of the victims are children under age of 12——even infants and young children.Chinese media repeatedly reported sexual assault cases of minors.Public security organs,People's procuratorates and People's courts devote a lot on investigation on such cases which highlights the seriousness of the sexual abuse of minors crime.Due to immature physiological and psychological development,minors have poor knowledge of sex,insufficient sex education,weak awareness of sexual safety and sexual prevention,which are easily violated by criminals.In addition,sexual assault will cause serious trauma and impact on minors' physiology and psychology,both of which are difficult to remedy and difficult to recover,not only infringing on the interests of minors but also hindering the healthy growth of minors.The public pays great attention to the crime of sexual assault on minors,but the legislation lacks specific measures to prevent the crime of sexual assault on minors.Under the background of the legislation that severely punishes the crime of sexual assault on minors,it is also necessary to take specific preventive measures.In 2016,Cixi procuratorate of Zhejiang province with relevant departments jointly issued Measures for the Implementation of Information Disclosure of Sexual Assault to Minor Offenders(hereinafter referred to as "cixi measures"),which combines punishment with preventive measures to fundamentally reduce sexual offenders against minorsand protect public security.For more effective preventative against minor crime,protecting the legitimate rights and interests of minors,this paper tries to use survey method,comparative research and theoretical study in order to do research on the sexual assault minor crime personnel information disclosure system in China,analyze a series of problems,through the comparative study on the extraterritorial legislation regulation,combined with China's national conditions,by using for reference the experience of outside to put forward targeted suggestions and scientific improvement measures.This paper mainly expounds from four aspects:The first part discusses the foundations and basis of the information disclosure system of sexual offenders against minors,mainly including the legislative background,legislative basis and theoretical basis.According to the "Cixi Measures",it briefly introduces the relevant content and summarizes the Cixi Advantages of the Measures additionally analyzes the necessity and urgency of perfecting the information disclosure system of juvenile offenders.The second part discusses the controversy over the disclosure of information on sexual offenders against criminals.It analyzes the three main controversial points of whether it violates the right to privacy,the value conflict it faces,and the effectiveness of prevention,additionally makes clear the legitimacy and rationality of the information disclosure system for the criminal of sexual assault on minors.The third part,by using the comparative research method,the author analyzes the mode selection of information disclosure system for the criminal of sexual assault on minors in other countries,mainly including active disclosure mode and passive inquiry mode,and summarizes its experience and references.The fourth part puts forward Suggestions and Suggestions on the improvement of the information disclosure system of juvenile offenders in order to make the system more feasible,effective and scientific.
