The constitution of the international civil aviation security legal system mainly includes the following important international conventions: the 1963 Convention on Crimes and Certain Other Acts in Aircraft,the 1970 Convention on the Suppression of Illegal Hijacking of Aircraft,and 1971 Additional Protocols to the Convention on the Suppression of Illegal Acts Endangering the Safety of C ivil Aviation,and the 1988 Convention on the Suppression of Illegal Acts Endangering the Safety of C ivil Aviation,as well as relevant provisions and provisions in some United Nations conventions against terrorism.The 2010 Beijing Convention and the Beijing Protocol,which are currently in force,intend to adopt a new pattern of aviation criminal behavior to revise and inherit the traditional international civil aviation security legal system,and gradually modernize the convention system.With a view to more effectively preventing and punishing new types of aviation crimes and illegal interference.With the formulation and entry into force of the aforementioned conventions and protocols,the international civil aviation security convention system has also shifted from an earlier focus on regulating the distribution of national jurisdiction to the development of an aviation criminal law system that includes jurisdiction,crime,and punishment principles.In particular,since the 2010 Beijing Convention and the Beijing Protocol were enacted,the international civil aviation security convention system has granted countries with broader jurisdiction on the one hand,and on the other hand,it has proposed higher national responsibilities for each country.Requirements.As a large aviation country with a booming aviation industry,China has made a correct understanding of these international civil aviation security legal systems,in order to complete its appropriate transformation in domestic law,which has become a crucial step.For this reason,in addition to the introduction and conclusion,the text is divided into five chapters.The first chapter mainly discusses the background of the formulation of the Beijing Convention and the Beijing Protocol.By analyzing the content of several important conventions that make up the international civil aviation security legal system,it summarizes the limitations of the traditional aviation security legal system.C hapters 2,3,and 4 focus on the criminalization standards,crime jurisdiction system,and mutual legal assistance system of crimes against the safety of civil aviation.They discuss the new amendments to the 2010 Beijing Convention and the Beijing Protocol in detail.The content and relevant significance of relevant provisions of the international aviation crime innovation or amendment.C hapter V analyzes the specific transformation and application of various provisions of the international civil aviation security legal system in C hina in light of the current status of C hina's domestic law.In summary,this article will analyze the latest developments in the international civil aviation security convention system by sorting out the characteristics and deficiencies of the traditional international civil air security legal system—the Beijing Convention and the Beijing Protocol.The necessity of modernization and integration,and focuses on the specific amendments of the Beijing Convention and the Beijing Protocol to crimes against civil aviation in terms of conviction standards,jurisdictional norms,and mutual legal assistance systems,as well as their practical significance and insufficient regulations,Intending to make a correct interpretation and understanding of the detailed amendments to the Convention from the above three levels,grasp the core concepts of the international civil aviation security legal syst em,and finally combine China's domestic laws,from the specifics of aviation law,criminal law and administrative law Transform the situation,analyze the application of the provisions of the Convention in China's domestic law and face the predicament,and then propose the development direction of C hina's aviation security legislation.
