Research On Criminal Behavior And Criminal Personality’s Features Of Indiscriminate Killing

In recent years,the indiscriminate killing cases appear more and more frequently in the public.The great social harmfulness and unpredictable victims make every case report bring strong social panic,so it is urgent to prevent the indiscriminate killing.On the basis of collecting and collating 74 domestic and foreign indiscriminate homicide cases,this paper first starts with the criminal behavior of indiscriminate killing,and through the summary and conclusion of actual cases and the comparison with the criminal behavior of ordinary intentional homicide,and analyzes the behavior of homicide in phases from three aspects according to the time sequence of criminal acts:1.Behavior during the preparatory phase of a crime:the vast majority of indiscriminate murderers have a clear killing mentality,and their preparatory acts are strongly directive to others;2.Behavior during the implementation phase of a crime:the indiscriminate murderers usually have a simpler intent to kill when they commit the crime,and seek more victims,which results in four types of criminal acts:no difference in the objects of crime,openness,reliance on instruments of crime,and high destructiveness;3.Behavior after the completion of the crime:indiscriminate murderers are usually in a state of no resistance and passive inaction after the completion of the crime,and there are few acts such as surrender,escape,disposal of corpses and concealment of evidence after the crime.Analyzing the month,time and place of the high incidence of indiscriminate killing from two aspects of time and space is more conducive to studying the prevention and control measures of such cases.In terms of spatial characteristics,indiscriminate killings occur mostly in public places,roads,streets and schools and the surrounding areas,and are not related to the local economic level and social system.In terms of temporal characteristics,the incidence of indiscriminate killings tends to increase in general,with a high incidence season of spring and summer.In specific time periods,affected by the early peak brought about by school attendance at work,the highest number of cases occurs from 6 am to 12 am,followed by the late peak of 12 am to 18 pm after school.Secondly,according to the psychological type of the indiscriminate killers,the criminals in 68 cases can be classified into three types:the retaliatory criminal,the pathological criminal and the cathartic criminal.After summarizing and arranging the age occupation distribution,the family situation,the personal experience and the disposition characteristic four aspects,the analysis obtains three different kinds of criminal personality characteristics.The largest number of retaliatory offenders are aged between 20 and 49,with the highest number of unemployed in the occupational distribution,followed by workers and migrant workers;offenders from single-parent families account for a higher proportion,while many offenders’ families have major or minor conflicts;the vast majority of offenders do not have bad habits,but most have experienced setbacks or disputes with others in their professional lives;and in terms of personality characteristics,they are mainly extreme and withdrawn,with few words.In the specific motive of crime,the proportion of retaliatory criminals who kill because of work is the highest,followed by the problems of daily life and marriage,family contradictions.The abnormality of pathological offenders is mainly caused by three conditions:mental illness or history of mental illness,physical illness and drug addiction.The age distribution of such offenders is mainly from 20 to 39 years old,younger than the retaliatory offenders,the proportion of unemployed is higher,and the professional composition is more monotonous;the marital status of the offenders is unmarried,and most of them have family problems;in personal experience,the ratio of suicide tendency and violence tendency of the pathological offenders is very high;in character,most of these offenders are extreme and indifferent.Venting indiscriminate killing is the difficult point for crime prevention at present.These offenders mainly display the following three basic characteristics:1.The time interval between the offender and the crime is long;2.The cause of the crime cannot be understood by ordinary people;3.The offender vents his feelings through indiscriminate killing.In terms of age distribution,the majority of cathartic offenders are 20-29 years old,and their occupational structure is more uniform,with a small gap between the proportion of the unemployed and the students and staff;the majority of the unmarried offenders in the family situation,at the same time the number of people from single-parent family is higher,many offenders are in a bad family environment;the number of the cathartic offenders with suicidal tendency is higher,but the main personal experience characteristics are that the offenders indulge in the network or games and have abnormal speech and behavior;In terms of personality characteristics,the most important characteristics of the cathartic offenders are deviated from the normal personality disorder and self-emotional closure.Finally,according to the criminal behavior characteristics,criminal’s personality characteristics and the analysis of the root causes of indiscriminate killing related preventive measures.The fundamental reason for the crime of indiscriminate killing lies in the unsatisfied demand,especially in the lower level demand in Maslow’s theory of demand hierarchy.The performance of the generalization of the perpetrator homicide can be attributed to the fact that the perpetrator,after suffering unbearable pain,transfers the pain to others due to the influence of projection effect and external stimulation and eliminates the pain by killing the transferred object.In terms of preventive measures,macro-level countermeasures include establishing a balanced and rational social structure politically,creating a moral environment of fairness and justice morally,and enhancing individual independence culturally while emphasizing collectivism further.In specific areas,an early warning system for indiscriminate killing should be constructed.On the one hand,according to the analysis on indiscriminate crime behaviors and criminals,22 risk assessment indicators are put forward,based on which the community can judge whether certain persons have criminal tendencies.At the same time,set up the list of high-risk personnel meeting more indicators,and not only pay key attention to such personnel in the community,but also actively form an exchange mode of information with their families and entities(or schools),and observe whether the high-risk personnel have the precursor characteristics of crimes from all perspectives,so as to carry out more comprehensive prevention and control.On the other hand,to strengthen the high incidence of sites and time period of prevention and control efforts.Increase in the highest incidence of street,road police on duty frequency,strengthen the monitoring of vehicles in abnormal driving conditions.The campus and traffic stations with distinct characteristics should increase the security personnel and police force according to the time period,and strictly restrict the entry and exit of the outside personnel.In public places to further strengthen the control of dangerous goods,such as knives,gasoline,improve the current regulatory gap in the control of volatile organic solvents addictive components.Community vigilance during spring and summer,when there is a high incidence of indiscriminate killing,and economic and material provision of material goods or allowances to persons concerned,In the aspect of psychological counseling,the positive psychological guidance should be strengthened,and the living area of the dangerous persons should be listed as the key patrol site in the monitoring management,and community monitoring facilities should be added and maintained regularly.
