Research On Legal Issues Of Sports Brokerage Contract

The emergence of sports brokers followed the need for a professional division of labor of professional sports and was gradually growing with the boom of the modern sports industry.Nevertheless,in recent years,there have been frequent rumors of disputes involving athletes and their sports brokers,including the contract dispute between the famous boxer Zou Shiming and his former brokerage firm Shenglishijia,"the double contracts" penalty case between CBA player De Lehei and Qingdao Guoxin Double Star Club,and the contract dispute case between tennis genius Xu Shilin and Qianrui Company,etc.Many of the legal issues in question are controversial in practice and remain unresolved.How to ensure that athletes are reasonably compensated for the professional services of a sports agent and that both interests are appropriately balanced to reduce disputes is a pressing legal issue that needs to be addressed.Accordingly,in this article,the author will first briefly introduce sports brokers and then proceed to clear up the legal relationship between athletes and sports brokers in terms of rights and obligations based on the above typical cases.The paper then explores the nature of sports brokering contracts.If athletes and sports brokers agree in a contract to delegate only certain matters and no other elements,then it is acknowledged that the contract is delegated,and vice versa,a mixed contract having many special contractual elements.As a result,this article focuses on legal issues related to sports brokerage contracts,including the legal effect of the "double contracts," relevant legal issues regarding the termination of contracts,as well as the applicability of liquidated damages.Finally,a proposal to refine China's sports brokerage contract system is proposed by the author,hoping that the interests of both parties to the contract will be protected and bring a positive effect towards the local sports industry growth.
