Study On The Judicial Dilemmathe And The Way Of Determination Of Work-related Injury That Dead In 48 Hours

Since the 2013 Regulation on Work-related Injury Insurance was formulated and implemented,There is a dispute about the identification of “Rescue ineffective death within 48 hours”.Because of identificationis limited to the form Standard and the existing provisions are not clear,the judicial practice Based on the above problems,the following two levels of corresponding suggestions are proposed : at the legislative level,it is necessary to introduce substantively determined standards on the basis of the original formal standards-the reasons for their work,refine and clarify the existing regulations and ncrease the level of work-related injury treatment;at the judicial practical level,we must follow the basic principles of work-related injury identification(legitimacy,the biased protection of workers,measurement of interests and benefits,proper procedures).
